Title: Tribal Resolution Adult Detention Agreement with the Gila County Sheriff’s Office

Description:

Tribal Council approved an Intergovernmental Service Agreement for Housing Detainees with the Gila County Sheriff's Office to provide for the detention and care of detainees detained under the authority of the Tonto Apache Tribe at the Gila County Detention Facility. This agreement was made because the Tribe does not have its own detention facilities to house detainees who are under the authority of the Tribe.

South Dakota

Title: Public Safety Improvement Act (SB 70) - Tribal Parole Pilot

Description:

In February 2013, Governor Daugaard initiated and signed into law the Public Safety and Improvement Act (SB70) to address state criminal justice reform, including authorizing the Department of Corrections to create parole supervision pilot programs responsive to tribes. In May 2014, the Sisseton-Wahpeton Oyate (SWO) and the State of South Dakota entered into an Intergovernmental Agreement which allowed the SWO to supervise Department of Corrections parolees enrolled tribal members on the Lake Traverse Reservation. The purpose of the Tribal Pilot was to reduce the number of tribal members returning to prison, provide increased compliance with parole conditions, and increase safety in the community. The Pilot has two main components: 1. the establishment of a tribal parole office, and 2. establishment of a Wellness Team. 

The South Dakota Department of Tribal Relations reported an update on the pilot in July 2015. The Vera Institute of Justice issued a brief on the program in October 2016. Access FAQs here.

Washington

Title: Agreement on Funerals, Death Bed Visits
Parties: Squaxin Island and Washington State Department of Corrections (DOC)

Description:

With this agreement, DOC makes provisions to its existing funeral leave policy to acknowledge and accommodate tribal customs without compromising public safety. For the duration of the death bed/funeral visits, the DOC will release specific offenders to highly trained Squaxin Tribal Police officers who are cross-commissioned with the Mason County Sheriff’s Office. Offenders must meet certain criteria, such as being a tribal member or immediate family member of an enrolled member of the Squaxin Island Tribe. The offender, family, or Squaxin Island Tribal Executive Leadership is responsible for mileage for special transportation accommodations between where the offender is housed and the Washington Corrections Center (Center), and salary and benefits of the employees escorting the offender during the trip. The DOC covers mileage and employee costs if the offender is transferred to the Center via regular transportation, and general expenses for the offender while at the Center. Should the offender escape or refuse to leave tribal lands, DOC and Squaxin Island Tribal Executive Leadership share concurrent jurisdiction. Squaxin Island Tribe has also created an Inmate Resource Guide to share with incarcerated persons and their families.
